READ THE FOLLOWING USE CONDITIONS AND DISCLAIMERS IN THIS AGREEMENT BEFORE INDICATING YOUR ACCEPTANCE. In this agreement, the term "you" refers to: (i) an individual purchasing an ECGsource subscription, either on his or her own behalf or as agent for an institution or other entity; or (ii) an individual consenting to this agreement as a condition of using ECGsource through a subscription purchased by an institution or other entity.

LICENSE: ECGsource, with appropriate payment of the applicable subscription fee and acceptance of this Agreement, grants you a non-exclusive, non-transferable license and right to use and access the ECGsource database and online software (the "Licensed Materials") in accordance with the applicable subscription terms.

INDIVIDUAL SUBSCRIPTION LICENSE: An Individual Subscription License permits a single individual to access and use the Licensed Materials by using his or her unique email and pasword to access the Licensed Materials from any location via the Internet.

INSTITUTIONAL SUBSCRIPTION LICENSE: An Institutional Subscription License permits a single representative of a specified institution to access and use the Licensed Materials by using his or her unique email and password from any location via the Internet.

OWNERSHIP: The Licensed Materials, including but not limited to all copyrights and other intellectual property rights contained therein, are the sole and exclusive property of ECGsource or its affiliations. By indicating that you accept these terms, you do not become the owner of the Licensed Materials, but are entitled to use them according to the terms of this Agreement.

PERMITTED USES: You may print out, store, or email insubstantial portions of the Licensed Materials, but only for your (1) personal use; (2) educational purposes; or (3) consultation with individual colleagues, provided that any printed, stored, or emailed materials include a source reference to ECGsource and its copyright notice. You are not permitted to print, store, or email substantial portions of the Licensed Materials, nor to email materials to large numbers of recipients.

PROHIBITED USES: Except as permitted in this Agreement, any copying, reproduction, transmission, distribution, or modification of the Licensed Materials is strictly prohibited. No part of the Licensed Materials may be copied for resale or other commercial use, or posted electronically on public web sites or internet chatrooms. No part of the Licensed Materials may be altered and included in other databases or software. ECGsource reserves the right to change, suspend, and/or cancel your access to ECGsource without notice if a violation in this license agreement is established or suspected.

SUBSCRIPTION TERM: You have obtained the right to use and access the Licensed Materials for a limited and pre-specified period of time, i.e. the length of the subscription period for which you or your Institution have appropriately purchased. At the end of this period, your license and your associated rights, including technical support, will expire automatically, unless you or your institution elects to renew your subscription according to the current ECGsource Licensing Agreement Terms and Conditions. ECGsource will also terminate your subscription if you fail to comply with the terms and conditions contained herein.

RESTRICTION AGAINST TRANSFER: You may not sublicense, share, sell, lease, or otherwise transfer your right to use the Licensed Materials for any reason.

PROFESSIONAL LIABILITY: The creators and editors of ECGsource have carefully attempted to ensure that the Licensed Materials are accurate and conform to medical standards in existence at the time of publication. The Licensed Materials are to be used as an educational tool, but are not meant to be the sole educational resource for the users of ECGsource. ECGsource will in no way assume liability for any certification being sought by its users, including but not limited to, passing of medical board exams. Users are encouraged to consult other references to further expand their knowledge and skills in ECG interpretation. The License Materials are not designed to be directly used in individual patient care and should not replace sound professional judgement.

LIMITED WARRANTY: If you are unsatisfied in any way with the service supplied to you by ECGsource, ECGsource will refund your payment fee provided (1) you have worked LESS THAN 30 composite ECG tracings, EchoSource cases, and CathSource cases on ECGsource.com, and (2) you request such refund in writing within 30 days of your registration and fee submission. There will be no refund issued if (1) you have worked 30 OR MORE composite ECG tracings, EchoSource cases, and CathSource cases on ECGsource.com, OR (2) your request is not submitted within 30 days of initial registration and fee submission. ECGsource is not liable to your or any other party for any incidental, special, or indirect damages, including loss of data or profits, failure to pass medical board exams, or for the inability to use Licensed Materials. In no event shall ECGsource have liability for damages or loss to you or any other party that exceeds the fee paid for the Licensed Materials.

PRIVACY POLICY: We respect your privacy. Therefore we never share or sell your personal information with any third parties. Any information collected through this site is intended to be used for this transaction only. Your personal information is secured via SSL (Secure Socket Layer) Technology.

GENERAL: If any provision of this Agreement is determined to be invalid or unenforceable under any applicable law, it shall be deemed omitted and the remaining provisions shall continue in full force and effect. This Agreement shall be governed by and construed in accordance with the laws and in the state and federal courts of the State of Texas, United States of America.
